These are the terms for using the website adamcapital.nl. Participation in A-DAM Capital Fund A is not governed by these terms but by the fund terms and the information memorandum of the fund. You receive those documents during the application process and they prevail in case of conflict.

1. Who we are

This website is operated by Amsterdam Digital Asset Management B.V., with its registered office at Eerste Amstelvlietpad 84, 1096 GB Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce under number 81122608. We are the manager of A-DAM Capital Fund A, a closed mutual fund under Dutch law (fonds voor gemene rekening). We are registered with the Dutch Authority for the Financial Markets (AFM) under number 50027021 on the basis of the registration regime of Section 2:66a of the Dutch Financial Supervision Act (Wft).

2. Supervision and target group

The fund falls under the registration regime and is not subject to ongoing supervision by the AFM or De Nederlandsche Bank. Participation is open only for an investment of at least € 100,000 per participant. The information on this website is not intended for persons in jurisdictions where offering or advertising the fund is not permitted.

3. No advice, no offer

The information on this website is general in nature and is provided for information purposes only. It does not constitute investment advice, an offer or an invitation to make an offer to participate in the fund. A decision to participate should be taken solely on the basis of the information memorandum and the fund terms, preferably after consulting your own adviser.

4. Risks

Investing in digital assets carries high risks. The value of your participation can fluctuate strongly and you may lose your entire investment. Past performance is no guarantee of future results. The fund is tax transparent; the tax consequences of participation depend on your personal situation.

5. Price information

This website shows two kinds of prices.

• The official monthly price is the price per unit set at the monthly valuation of the fund. Participants subscribe and redeem at this price. Returns in the monthly and annual tables are calculated on consecutive official monthly prices.
• The indicative daily price follows from the daily valuation of the fund assets on the blockchain. This price is indicative only, may deviate from the official monthly price, and no rights can be derived from it.

The CCI30 index is shown as a benchmark. We are not responsible for the accuracy of data originating from third parties. Price information may be updated with a delay.

6. Intellectual property

All texts, images, logos, charts and software on this website are the property of Amsterdam Digital Asset Management B.V. or its licensors. You may consult and print the content for personal, non-commercial use. Any other use, including reproduction, distribution or modification, requires our prior written consent.

7. Liability

We take care over the content of this website but do not guarantee its completeness, accuracy or timeliness. We are not liable for damage arising from the use of this website or from reliance on the information on it, except to the extent that such damage results from our intent or deliberate recklessness. Nor are we liable for the temporary unavailability of the website.

8. Third-party websites

This website may link to third-party websites, including the blockchain explorer with which you can verify fund transactions. We have no control over the content of those websites and accept no responsibility for them.

9. Personal data

How we handle data you provide to us through this website is set out in our privacy statement.

10. Complaints

If you have a complaint about this website or about us, we would like to hear from you at info@adamcapital.nl. We confirm receipt within five working days and aim to resolve the complaint within four weeks.

11. Applicable law

Dutch law applies to the use of this website and to these terms. Disputes will be submitted to the competent court in Amsterdam.

12. Changes

We may amend these terms. The current version is always on this page, with the version number and date at the top.
